End User License Agreement

Important: This "End User License Agreement" (hereinafter referred to as "this Agreement") constitutes the end user license agreement for this Software signed by you (individual, company or other organization) and Malitel Games Technologies Co., Ltd. Malitel Games kindly asks you to read all terms and conditions contained within this Agreement carefully, including but not limited to usage information, legal responsibilities and limitations of liability. By installing and using this Software, you will be deemed to have accepted the terms and conditions in this Agreement. If you install or in any way use this Software, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms and conditions in this Agreement, you may not install or use this Software.

This Agreement represents the contract made between you and Malitel Games relating to the download, installation and use of this Software. This Agreement stipulates your rights and obligations regarding the use of this Software.

1. Intellectual Property

This Software was developed by Malitel Games or was licensed to Malitel Games by the owners of the software (hereinafter referred to as "Licensors"). The intellectual property rights for this Software and all information and content related to this Software, including but not limited to written descriptions and their combinations, icons, images, diagrams, colors, interface designs, page layouts, associated data, printed materials and electronic documents are protected by copyright law, international copyright treaties and other laws and regulations governing intellectual property. All such intellectual property shall remain the property of Malitel Games and its Licensors.

2. Grant of license

1. (1) Malitel Games and its Licensors reserve all rights not expressly granted herein. If you need to use any other rights not granted herein, you must obtain written consent from Malitel Games.

2. (2) When using a third-party application on this Software, a separate service agreement should be signed with the third party.

3. (3) Malitel Games grants you a limited, non-transferable, non-sublicensable, revocable and non-exclusive license to download, install and run this Software on a Malitel Games phone.

4. (4) You may download, install and run a single copy of this Software on one Malitel Games phone only.

3. Usage restrictions

You may use this Software in accordance with this Agreement subject to respecting national laws, regulations and policies and abiding by this Agreement. You are not entitled to, nor may you engage in any unauthorized behavior, including but not limited to the following:

1. (1) Deleting any copyright claims or notices or any other information and content contained in this Software.

2. (2) Reverse engineering, reverse assembly, reverse compiling or performing other similar operations on this Software.

3. (3) Using, copying, editing, leasing or transferring this Software or any part of it outside the scope of the terms stipulated herein.

4. (4) Providing this Software to third parties, licensing other parties to use this software or using this Software for unauthorized purposes (e.g. commercial purposes).

5. (5) Engaging in any unauthorized behavior relating to the images, text and other relevant content contained within this Software, including but not limited to the following: using, copying, editing, adding links to, reproducing or publishing content, establishing a mirror site or using this Software to develop derivative products or related software or services without permission.

6. (6) Using this Software to store, publish or disseminate content that violates national laws, regulations and policies.

7. (7) Using this Software to store, publish or disseminate content that infringes the legal rights of other parties, such as intellectual property rights and trade secrets.

8. (8) Engaging in behavior that jeopardizes the security of computer networks.

4. Technical support

Under this Agreement, Malitel Games and its Licensors shall not provide any technical support services relating to this Software.

5. Version updates

Malitel Games shall decide whether to provide updates to this Software in the future. If Malitel Games agrees to provide a software update, this Agreement shall still apply to the updated version, unless a replacement software license agreement is provided. If the software is designated as an updated version, you must abide by this Agreement.

6. Limitations of liability

1. (1) You agree that all risks associated with using this Software shall be borne by you.

2. (2) You acknowledge that this Software may be affected by various security issues, such as the use of your information by other parties to send you spam. Downloaded software may contain Trojan horses and other viruses which jeopardize the security of your information and data and therefore may affect the normal operation of this Software. You should strengthen the security of your information and improve your awareness of data protection. Ensure that you use password protection in order to prevent you from incurring losses and to avoid spam.

3. (3) This Software is provided "as is". Malitel Games and its Licensors make no representations or warranties regarding this Software, either express or implied, including the warranties of merchantability, fitness for a particular purpose and non-infringement.

4. (4) To the maximum extent permitted by applicable law, Malitel Games and its Licensors shall not be liable for any direct, indirect, accidental, special or punitive damages or any other damages caused by or related to the use of this Software or the inability to use this Software (including but not limited to damages arising due to personal injury or damage to property, lost profits, business interruption and leaking of trade secrets, damages caused by the leaking of personal information due to not exercising duties including sincerity and reasonable care, damages caused by negligence or any damages arising due to financial losses or any other losses), even if Malitel Games and its Licensors are given prior notice of the possibility of such damages occurring. The liability assumed by Malitel Games and its Licensors shall not exceed the amount you paid for purchasing this Software. This clause shall be effective under any circumstances.

5. (5) Any other software derived from this Software without the authorization of Malitel Games and its Licensors is illegal. Downloading, installing and using this kind of software may result in unpredictable risks. You are advised to exercise extreme caution when downloading, installing and using such software; all losses, damages, legal liabilities and consequences of disputes shall be borne by you and are not related to Malitel Games.

6. (6) All damages arising due to the violation of laws or this Agreement shall be borne be you. In the event that such violation results in damages to Malitel Games, Malitel Games reserves the right to demand full compensation from you.

7. Termination

Malitel Games or its Licensors reserve the right to suspend or terminate this Agreement at any time. Upon the termination of this Agreement, you must stop using this Software immediately and delete all installed software and any associated data that you have copied.

8. Other terms and conditions

1. (1) Should any provision of these terms and conditions be or become invalid in whole or in part, the validity of the other provisions shall not be affected.

2. (2) The interpretation and validity of this Agreement and the resolution of disputes resulting thereof shall be governed by the laws of the People's Republic of China. Any disputes arising under this Agreement shall be settled through friendly consultations. In the event that no settlement can be reached through such consultations, you hereby give your full consent for the dispute to be submitted to the Shenzhen Arbitration Commission for arbitration. The arbitral award is final and binding upon both parties. All arbitration costs shall be borne by the unsuccessful party.

3. (3) Should you have any questions relating to this Software, you can call the Malitel Games customer service hotline for more information.

In order to improve product stability (including the "Malitel Games App Center", "Malitel Games Game Center" and "Third-party widgets used within the Malitel Games App Center and the Malitel Games Game Center), Malitel Games will collect error messages and technical data when you are using the product. Malitel Games kindly asks for your authorization to collect and analyze the following information:

I. 1. Device information: such as phone operating system, phone language, device model, phone network mode and phone SIM card.

II. 2. Client information: such as client version number, download method and the time the user opens/closes the client.

III. 3. App information: such as app error messages and whether the service was enabled.

If you do not want the above information to be collected and analyzed by Malitel Games, please do not continue and exit this application.

This Software requires Internet access during use. Any data charges arising as a result shall be collected by the network operator; please contact your local network operator for details.
